Over the past year I've been a battle with the Department of Family Division Services.
According to the government entity, any funds transferred to the mother of my child for her health and well being as dictated through court order is deemed a gift.
Unfortunately, the Department of "Family Services" is a ridiculous bloated bureaucracy which dismally failed an audit earlier this year. The public humiliation of the marked failure hasn't stopped the department from ruining people's lives - including the disruption of my own.
Please note, this is big government and protecting a multi-billion dollar cottage industry built upon the social trend of broken families is the catalyst behind the politics.
Under normal circumstances, one parent sends a check to Jefferson City and a credit card issued to the primary custodian is credited within a few days. Unfortunately, in my case, the state doesn't always handle the money well - it could be days, weeks or sometimes the Department of Family Division Services doesn't even credit money at all.
Likely story right?
A lot of the services I provide on this website, such as the 800 number to the right side of this page were created to close the gap between my daughter and me. The number is a non-combatitive way for communication between my child and I to continue whether or not my child's other parent and I are getting along.
To prove the Department of Family Division services dismal failure in facilitating transfer of funds I withdrew money from my bank account last October and handed the money order to "the other parent".
She filled out the form, enclosed the money in an envelope with the necessary notations and sent the check to Jefferson City. In regular form - the state never credited the account.
Taney County and Christian County, where my child's parents live are both under the jurisdiction of the 38th Circuit Court. Here's where things get interesting. The Christian County Sherriff has a policy of ignoring court orders that aren't distributed through the county. In other words, if I want to enforce transfer of custody, the Sherriff will obey the law of Christian County but not the law of the state of Missouri (Enforcement of State Statute varies from county to county). Ironically, the sitting family judge in Christian County - same circuit - was the attorney who negotiated my parenting plan.
Let's review:
1. Missouri Department of Family Services - Stealing money out of my kids mouth, fails to distribute money to other parent for care of my child when sent to the state
2. Christian County Sherrif Department - Ignores state statute, refuses to follow Missouri Constitution or abide my Missouri Law.
Here's where things get interesting. The Christian County Prosecutor's office has a special grant from the Department of Family Services. The same department that has a record of stealing money from my family has plenty of money to help prosecute me for not participating in their thievery. If succesful, the state can imprison me for 4 years at a cost of $248,000 to taxpayers for a $3.000 debt.
As you'll see, if you haven't followed this blog for the past three years, I have a good understand of the judicial system. I have a working understanding of the consitution of the United States of America and the State of Missouri. These documents are of no interest to some government officials as I've learned firsthand.
Once in a while I try to remind readers that these core documents which provide the foundation of American democracy were earned through the blood of patriots who fought against the tyranny of the corrupt. These were my ancestors, my daughters ancestors and those born on this soil have been given a gift.
When I speak of the importance that we remain free and self-governed - I'm talking about our efforts today. I'm speaking of a generation's duty and a fight that must continue and cannot be guaranteed from one generation to the next. There is a constant fight to ensure another generation remains free. I fight for open government for my own child, so she may live free.
Here in Southern Missouri there are compromises being made. There are government entities who believe they are above the law. There are agencies that treat the constitution as a document they can do without and have no obligation to protect.
Those elected have took an oath. And if they fail to oblige their duty, if they fail to honor their oath - they are nothing more than liars urinating on the graves of our nation's fallen soldiers. This may happen often without recourse. But, it's not going to happen on my watch if I have a say in the matter.
In the meantime, I'm setting up a bank account. Money will be deposited in the account and my child will not starve because of Missouri’s Department of Family Division’s irresponsibility. My support is not a gift but rather the fulfillment of the command of Judge Justus. And if an extended stay in prison results, it will be from the conviction of a jury of my peers – which will probably not happen, because the average man or woman seems to have more moral fortitude than the average politician.
